We offer other services on this website which may be subject to additional terms and conditions. For example, if you use services rendered by Kasa Designs Shop, you are also subject to the Kasa Designs Shop Terms.  You accept these terms and conditions by visiting, interacting with content, or ordering products or services from this site. TERMS OF SERVICES
 

By ordering from P5 Publishing (kasadesignsshop.com/p5publishing) you are electing to purchase and/or contract a service with us and therefore agree to abide by the terms and conditions set herein. 
 

1.    Our contract

When you place an order online, you will receive an acknowledgement of your order. This acknowledgement does not constitute a contract between you and us.  A contract is formed only when a service agreement is formed by us and received by you. This agreement is formed either by (a) receiving an email from us confirming the order and receipt of your payment, providing service procedure and an estimated timeframe of service completion; or (b) by signing a written contract with us which details the terms and conditions of the service.
 

2.    Payment

Payment of your order may be processed on our website through the many payment options provided. However, other payment methods are available depending on the selected service.  Upon receipt of such payment, a pre-authorization check is conducted to ensure that funds are available to fulfill your order. Once the payment is successful, we will commence work on the service you selected.
 

3.    Delivery

Website Design Projects
Preview of your initial website design concepts is within five (5) to ten (10) business days. A more reliable timeframe will be communicated to you in your service agreement or our proposal. Express services may be arranged at an additional cost by requesting it with your order form or by discussing it with us prior to commencement of the design project. Final delivery of your website after preview of the initial design concepts will be communicated at that time. Some website design projects include ongoing service contracts. 

Other Design Projects
Preview of your initial design concepts is within five (5) to ten (10) business days. A more reliable timeframe will be communicated to you in your service agreement or proposal. Express services may be arranged at an additional cost by requesting it with your order form or by discussing it with us prior to commencement of the project. Final delivery of your designs after preview of the initial design concepts will be communicated at that time.

All Other Services
An agreed upon timeframe will be communicated to you in the proposal, quotation, or services agreement we submit to you prior to ordering your service.

4.    Copyright Transfer
 

Publishing 
You confirm that you have copyright of all content and materials you submit to us or at least have permission from the owners to use them. Upon completion of our service and publishing of your work, you and the appropriate copyright holders will continue to retain your full copyright.

Design
Upon completion and receipt of payment of the design project, 100% full copyright of the design will be transferred from us to you.  

5.    Right to Display 

By contracting with us, you agree that we reserve the right to display any designs, logos, icons, brands, word marks, images, books, websites, or any visuals that we create on your behalf in our portfolio.

6.    Other Works

We may promote works from our affiliates and other publishers, with whom we may or may not have contractual affiliation. We do not assume ownership or copyrights to their work.

7.    Cancelation and refund

We offer fifteen (15) days cancellation provision subject to administration costs of $100 or 50% of the order, whichever is less. Therefore, if for any reason you decide to cancel your service order, contact us within fifteen (15) days of submitting your order and prior to receiving your initial design concepts to receive a refund of 50% or less $100 whichever is less. There is no refund once you have reviewed the initial design concepts. We are happy to work with you to ensure that you are satisfied with your designs.

INDEMNITY
 

You agree to indemnify, defend, and hold harmless P5 Publishing, its owners, parent, directors, officers, employees, consultants, agents, subsidiaries, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this website or your breach of the Terms. 
 

DISCLAIMER OF LIABILITY
 

The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law P5 Publishing and its content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.
